The Relationship Between Concept Of Dawabit Fiqhiyyah And Dawabit Usuliyyah: A Descriptive Study

This research rectifies the interference that occurred between contemporary writers when talking generally about the concept of dawabit and dawabit fiqhiyyah in particular. That is because they have made all the relevant dawabit in all other Sharia Sciences with dawabit fiqhiyyah. Also, they have not explained the fact of the dawabit, its consequences and have not elaborated on its uses. Some of them did not talk about the existence of an independent science called "dawabit fiqhiyyah". For this reason, talking about the science of controls as an independent science still ambiguous and needs a clear statement that reveals its truth and distinguishes it from others. The research method will be descriptive and historical. Therefore, this research will clearly identify this science and it will be a reference for researchers in distinguishing between the meaning of dawabit and its uses. First use, general use, which number of uses that are included in all other sciences and it is included in in the general case, definition, the measure, its divisions, conditions and causes. Second use, a special use, which is the general case that applies to its parts and between the dawabit as an independent science and this is only in dawabit fiqhiyyah. This research has come to define the dawabit in terms of the singular definition, composition, being an independent science and its relationship with dawabit usuliyyah. The most important results of this research are that the dawabit is used in terms of its title on two sides, a specific use which is the main case and a general use, the definition, mentioning the measure of the case, a statement of its divisions, conditions, and causes. Moreover, dawabit may be described as a compound term of two parts, as it is assigned to one of the fields of science, such as the grammar (arabic nahw), and qawa‘id usuliyyah and this is the general usage. Also, the dawabit usuliyyah is everything that controls the qawa‘id usuliyyah as restrictions within the structure of usul fiqh. Besides, there is no independent knowledge of dawabit other than dawabit fiqhiyyah and it can be defined that is organized similar perception in a single jurisprudential (fiqhiyy) subject is not considered to a comprehensive and influential agreement.

سيسعى هذا البحث لمعالجة التداخل الذي حدث بين الكتّاب المعاصرين عند الحديث عن الضوابط الفقهية؛ وذلك أنهم جعلوا جميع الضوابط المختصة في جميع الفنون الشرعية من قبيل الضوابط الفقهية، وهم لم يبينوا حقيقة الضابط وإطلاقته ولم يفصّلوا في استعمالاته ، كما أن البعض لم يتحدث عن وجود فن مستقل اسمه "الضوابط الفقهية"؛ لهذا ما زال الحديث عن علم الضوابط كفن مستقل يكتنفه الغموض ويحتاج إلى بيان يكشف حقيقته ويميزه عن غيره، ولذلك فإن هذا البحث سيتعرف عن هذا العلم بشكل واضح ويكون مرجعاُ للباحثين في تمييزهم بين الضابط بشكل عام وبين الضابط كفن مستقل، وقد جاء البحث معرفاً عن الضابط من حيث اللقب المفرد، ومن حيث التركب، ومن حيث كونه فن مستقل، ومن ثم علاقته بالضوابط الأصولية.
