Abstract

The fatwa institution has always been a reference point for Muslims in Malaysia because the fatwa is recognized as one of the sources of Islamic law in Malaysia. This article aims to discuss the Sisters in Islam (SIS) that rejects the fatwa institution and some of the fatwa issued by the fatwa institution in Malaysia. This was the result of SIS's view that the fatwa and its institutions violated human rights in freedom of expression, freedom of association and religious freedom which, according to the SIS, was contained in the Federal Constitution of Malaysia. In addition, the fatwa institution is said to be infringing on federal jurisdiction whose federal jurisdiction is only parliamentary, which has legislative powers to limit human rights. This study uses content analysis design by applying a document analysis approach as the primary data collection method. The results of this study have shown that there is an organization in Malaysia and its leadership is led by Muslims themselves but has rejected an institution which is the main reference of Muslims and the interests of the fatwa itself.

 

Institusi fatwa sentiasa menjadi tempat rujukan bagi umat Islam di Malaysia kerana fatwa diiktiraf sebagai salah satu sumber perundangan Islam di Malaysia. Artikel ini bertujuan untuk membincangkan berkenaan Pertubuhan Sisters in Islam (SIS) yang menolak institusi fatwa serta sebahagian  fatwa yang dikeluarkan oleh institusi fatwa di Malaysia. Perkara ini berlaku disebabkan SIS berpandangan bahawa fatwa dan institusinya telah melanggar hak asasi dalam kebebasan bersuara, kebebasan bersekutu dan kebebasan beragama yang mana menurut SIS ianya telah terkandung dalam Perlembagaan Persekutuan Malaysia. Selain itu, institusi fatwa tersebut dikatakan turut mencerobohi bidangkuasa persekutuan yang mana bidangkuasa persekutuan ini hanya parlimen sahaja yang mempunyai legislatif untuk membatas hak-hak asasi manusia. Kajian ini menggunakan reka bentuk analisis kandungan dengan mengaplikasikan pendekatan analisis dokumen sebagai kaedah pengumpulan data yang utama.  Hasil kajian ini telah memperlihatkan berkenaan sebuah pertubuhan yang ada di Malaysia dan kepimpinannya diterajui oleh orang Islam sendiri tetapi telah menolak sebuah institusi yang menjadi rujukan utama umat Islam serta kepentingan fatwa itu sendiri.
