Known that pregnancy is when hypercoagulable state happened whereby anti-coagulant factors in women body such as protein C and protein decrease. Such condition would normally put mothers in risky state if circumstances of health matter are not well observed. Recently, 2016/2017 statistic of Malaysia indicated that principal cause of maternal death around pregnancy is Venous Thromboembolism (VTE) particularly Pulmonary Embolism (PE). Due to that, this crucial phase should prioritize on prevention (al-wiqayah) before the worst happen. Not mentioned the treatment of obstetrical VTE is very serious to monitor, the medicine used for prevention of VTE called prophylaxis with anticoagulant agent of Low Molecular Weight Heparin (LMWH) in specific (Enoxaparin sodium) is also critical issue to be highlighted today. Therefore, the objectives of this research are to explore the legitimacy of Clexane as preventive medicine of VTE during pregnancy and puerperium which is being used in Malaysian government hospitals as permitted by Malaysia Ministry of Health (MOH). Secondly, to harmonize the decisions between authorities for instance Malaysia National Fatwa Council (MNFC), JAKIM and MOH decision regarding the prohibition of Clexane. This research which employed qualitative method found fatwa on Clexane in 2009 by MNFC is highly recommended to revisit. This research figured out that utilizing porcine based medicine such as Enoxaparin Sodium (Clexane) as preventive medicine from VTE can be considered as contemporary ijtihad of fatwa toward istihalah kuliyyah or istihalah sahihah due to the fact that it is more effective, safer and more economic to Muslim patients. This new dimension is indeed extending equally with the nature of Islam, mitigation (al-taysir) and elimination of difficulties (raf'ul haraj).
