Ibn Badis Juristic Renaissance In Algeria Between: (1913 – 1940)

Abstract

The aim of this research is to reveal the education renaissance carried out by the jurist Ibn Badis in Algeria, as well as to identify his personality and jurisprudential background. Additionally, the study investigates the most prominent education stations, educational curricula, and teaching methods that he considered useful and feasible. The research also examines his ways of breaking and passing French challenges against educating Algerian people. Furthermore, the study investigates to what extent he succeeded in overcoming these obstacles and challenges, and what was the addition that served as an icon for the advancement of education and the renewal of its facilities in Algeria. This study employed qualitative research, using the archives of Ibn Badis, library data collected from books, journal articles, and documents related to Ibn Badis. The collected data were processed using descriptive analytics. With both methods, the researcher reports and presents the collected data to be analysed and concluded. The research found that the background of Ibn Badis' jurisprudence had a clear impact on the contributions to the education renaissance in Algeria. For example, he built schools, institutes, and developed curricular for education, combining Islamic heritage and modernity. He was the first to pay attention to women's education after France forbade them for decades. The study also found that Ibn Badis set wonderful examples in the fact that the fields of scholars are diverse and multiple.

يهدف البحث إلى الكشف عن النهضة العلمية التي قام بها الفقيه ابن باديس في الجزائر، من خلال التعرف على شخصيته وخلفيته الفقهية، والوقوف عند أبرز محطاته العلمية، ومناهجه التعليمية، وطرق التدريس التي ارتآها نافعة ومجدية، فما هي الوسائل التي مكنت الفقيه ابن باديس من الصمود وفك قيود، العدو اللدود المتمثل في فرنسا وأزلامها الذين حرموا المواطن الجزائري من كل أنواع التعليم، لاسيما التعليم العربي والإسلامي والمواد العلمية كالإقتصاد والجغرافيا..، وتفننوا في قتل وتشريد العلماء والمثقفين، وحرق ونهب المساجد والمؤسسات التعليمية، ثم إلى أي مدى نجح في تخطي تلك العقبات والتحديات، وما هي الإضافة التي كانت بمثابة الأيقونة للنهوض بالتعليم وتجديد آلياته في الجزائر، اقتضت الدراسة أن تنحو المنهج التاريخي والمنهج الاستقرائي التحليلي، من خلال الكم الهائل الذي خلفه من أرشيف؛ كالمقالات التي سطرها بيده والصور التي وثقت الكثير من آرائه الفكرية والتربوية، ثم استقراء تلك النصوص والأعمال، وتحليلها تحليلا علميا، فمن أبرز النتائج التي توصل إليها البحث هي: أن خلفية ابن باديس الفقهية، كان لها أثر واضح في تميُّز شخصيته، وعمق فهمه، وبعد نظره، الذي انعكس بشكل واضح على اسهاماته في النهضة العلمية بالجزائر، كبناء المدارس والمعاهد، ووضع مناهج للتعليم تجمع بين الأصالة والمعاصرة، كما يعد أول من اهتم بتعليم المرأة بعد أن حرمتها فرنسا لعقود، بالإضافة إلى  ضربه أروع الأمثلة في كون مجالات العالم متنوعة ومتعددة .
