Aplikasi Sadd Al-Zarai’e Dalam Hukum Pengucapan Lafaz Talak Ta’liq Lisan: Analisa Terhadap Kes Terpilih Di Mahkamah Syariah Ipoh

Abstract

The concept of sadd al-zarai'e is one of the branches of usul fiqh. It is categorized as a theory in the legal reasoning of fiqh problems. This theory is better known as the disagreeable proposition. However, this theory can be used following the guidelines set by the shari'ak. Therefore, this study aims to identify the concept and application of sadd al-zarai'e in the science of usul fiqh. This study also examines the scenario of oral talak ta'liq pronunciation in selected cases in the Ipoh Syariah Court. This study was conducted to analyze the application of sadd al-zaraie in the judgment of 5 selected cases related to the pronunciation of verbal ta'liq that was registered in the Ipoh Syariah Court. The methodology for this study is to use a qualitative research design. Selected court cases were analyzed using document analysis methodology. The findings show that the pronunciation of oral ta'liq can be categorized into one main theme which is the attitude of the married couple and divided into 5 different issues. Among the issues are the husband hurting the wife, the husband cheating, the wife leaving the house, the wife forcing a divorce and the wife using the husband's phone without permission. Through the application of this concept of sadd al-zarai'e, it is hoped to avoid and reduce the occurrence of verbal ta'liq divorce which harms the marriage relationship. The role of the Syariah Court, the authorities, as well as the awareness and education of the community is very important to deal with this issue and maintain the sanctity of the institution of marriage following the goals of the Sharia.

Konsep sadd al-zarai'e merupakan salah satu cabang ilmu usul fiqh. Ia dikategorikan sebagai teori dalam pendalilan hukum terhadap permasalahan fiqh. Teori ini lebih dikenali sebagai dalil yang tidak disepakati. Namun begitu, teori ini boleh digunapakai selaras garis panduan yang ditetapkan oleh syarak. Oleh itu, kajian ini bertujuan untuk mengenalpasti konsep dan aplikasi sadd al-zarai'e dalam ilmu usul fiqh. Kajian ini juga untuk mengkaji senario pengucapan lafaz talak ta'liq lisan dalam kes terpilih di Mahkamah Syariah Ipoh. Kajian ini dijalankan bagi menganalisa aplikasi sadd al-zaraie dalam penghakiman 5 kes terpilih berkaitan pengucapan lafaz talak ta'liq lisan yang didaftarkan di Mahkamah Syariah Ipoh. Metodologi bagi kajian ini adalah menggunakan reka bentuk kajian kualitatif. Kes-kes mahkamah yang terpilih dianalisis menggunakan metodologi analisis dokumen. Hasil dapatan menunjukkan pengucapan lafaz ta’liq lisan dapat dikategorikan kepada satu tema utama iaitu sikap pasangan suami isteri dan dibahagikan kepada 5 isu berbeza. Antara isu tersebut adalah suami menyakiti isteri, suami curang, isteri keluar rumah, isteri memaksa untuk bercerai secara fasakh dan juga isteri menggunakan telefon suami tanpa kebenaran. Melalui aplikasi konsep sadd al-zarai'e ini, diharap dapat mengelakkan dan mengurangkan berlakunya perceraian ta’liq lisan yang memberi impak negatif terhadap hubungan perkahwinan. Peranan Mahkamah Syariah, pihak berkuasa, serta kesedaran dan pendidikan masyarakat amat penting untuk menangani isu ini dan menjaga kesucian institusi perkahwinan selaras dengan matlamat syarak.
