Abstract

This paper evaluates the principle of indefeasibility of land title in Malaysian land law through the framework of Maqasid Shariah, the higher objectives of Islamic law. As a core component of the Torrens system, this principle offers certainty and protection to registered proprietors. However, its rigid application especially in cases involving fraud or misconduct has the potential to conflict with the substantive justice envisioned in Islam. This study examines whether the current approach to indefeasibility aligns with the five essential objectives of Maqasid Shariah: preservation of religion (din), life (nafs), intellect (‘aql), lineage (nasl), and property (mal). Using doctrinal and normative analysis of selected statutory provisions and judicial decisions, this paper proposes a recalibration of the indefeasibility principle to better reflect Shariah values and Islamic conceptions of justice. The study contributes to the discourse on harmonising civil and Shariah law in the context of land ownership and calls for integrative and ethical legal reform.

Abstrak
Makalah ini menilai prinsip ketidaksangkalan hak milik tanah dalam undang-undang tanah Malaysia melalui kerangka Maqasid Shariah, iaitu objektif tertinggi dalam hukum Islam. Sebagai asas utama sistem Torrens, prinsip ini memberikan kepastian dan perlindungan kepada pemilik berdaftar. Namun, aplikasi secara mutlak terutamanya dalam kes penipuan atau salah laku berpotensi mencanggahi prinsip keadilan substantif dalam Islam. Kajian ini meneliti sama ada pendekatan semasa terhadap prinsip ini sejajar dengan lima objektif utama Maqasid Shariah: pemeliharaan agama (din), nyawa (nafs), akal (‘aql), keturunan (nasl) dan harta (mal). Melalui analisis doktrinal dan normatif terhadap peruntukan statutori dan keputusan kehakiman terpilih, makalah ini mencadangkan penyesuaian prinsip ketidaksangkalan agar lebih selari dengan nilai Syariah dan prinsip keadilan Islam. Kajian ini menyumbang kepada wacana penyelarasan antara undang-undang sivil dan Syariah dalam konteks pemilikan tanah, serta menyeru kepada reformasi yang bersifat integratif dan etika.
