THE EDUCATIONAL DIMENSIONS OF ISLAMIC FATWA: AN ANALYTICAL AND FOUNDATIONAL STUDY IN LIGHT OF THE QURAN AND SUNNAH

الأبعاد التربوية في الفتوى الشرعية: دراسة تحليلية تأصيلية في ضوء القرآن والسنة

Abstract

This study addresses the educational dimensions of Islamic legal rulings (fatwas) by analyzing Quranic and prophetic texts related to the context of question and answer. It also presents real-life examples of fatwas that reveal their deep educational functions. The paper begins with the issue that many contemporary fatwas focus on explaining the legal ruling in isolation, neglecting the educational aspect, which has a profound impact on refining behavior and correcting misconceptions. The study adopts an analytical foundational approach, where the researchers aimed to extract the educational dimensions manifested in fatwas, such as instilling self-faith monitoring, considering the condition of the question, gradual persuasion, addressing the issue's roots, building sound concepts, and utilizing rational arguments. The results show that the fatwa is not limited to being a declaration of the legal ruling, but rather serves as an effective educational tool that contributes to both individual and societal reform, enhances the deep understanding of Islamic law, and reinforces the faith-based and ethical values of the recipient, when formulated wisely with consideration of the context and the addressee, and when educational means are integrated with the legal objectives. The study recommends revisiting the way contemporary fatwas are presented to better incorporate educational dimensions. It also suggests the development of training programs for fatwa issuers to include educational skills and guide fatwas by the developments of society and the needs of individuals, while paying attention to the ethical and educational aspects of fatwas for social reform.

تتناول هذه الدراسة الأبعاد التربوية للفتوى الشرعية، من خلال تحليل النصوص القرآنية والنبوية التي وردت في سياق السؤال والجواب. كما تستعرض نماذج واقعية من الفتوى تكشف عن وظائفها التربوية العميقة. وقد انطلقت الورقة من إشكالية مفادها أن الكثير من الفتاوى المعاصرة تركز على بيان الحكم الفقهي المجرد، مع إغفال البعد التربوي الذي له أثر بالغ في تهذيب السلوك وتصحيح المفاهيم. واعتمدت الدراسة على المنهج التحليلي التأصيلي، حيث سعى الباحثون إلى استخراج الأبعاد التربوية المتجلية في الفتوى الشرعية، كغرس الرقابة الإيمانية الذاتية، مراعاة حال المستفتي، التدرج في الإقناع، معالجة جذور الإشكال، بناء المفاهيم السليمة، وتفعيل الحجج العقلية. وأظهرت النتائج أن الفتوى الشرعية لا تقتصر كونها بيانًا للحكم الشرعي فقط، بل تمثل أداة تربوية فعالة تسهم في الإصلاح الفردي والمجتمعي، وتعزز الفهم العميق للشرع. كما تُرسّخ القيم الإيمانية والأخلاقية لدى المتلقي، إذا ما صيغت بطريقة حكيمة تراعي المقام والمخاطَب، وتتكامل فيها الوسائل التربوية مع المقاصد الشرعية. وتوصي الدراسة بضرورة إعادة النظر في طريقة تقديم الفتاوى المعاصرة، بحيث تتضمن الأبعاد التربوية في الفتوى بشكل أكبر. كما ينبغي تطوير البرامج التدريبية للفتوى لتشمل مهارات تربوية، وتوجيه الفتاوى بما يتناسب مع تطورات المجتمع واحتياجات الأفراد، مع الاهتمام بالجانب الأخلاقي والتربوي في فتاوى الإصلاح الاجتماعي
